Amigo Affiliates, operated by Migo Media Private Limited (CIN: U73100HR2025PTC133358), is a B2B affiliate marketing network for publishers only. We are not a gambling operator, casino, or sports betting platform. We do not hold a gambling licence, accept bets, wagers, or deposits from end-users, or operate any gambling services. Our sole business activity is connecting affiliate publishers with independently licensed gambling operators in exchange for agreed commission payments (CPA and/or Revenue Share). All gambling activities take place exclusively on the licensed operators' own platforms.
1. Introduction and Scope
1.1. These Terms and Conditions govern your access to and use of the Amigo Affiliates website (amigoaffiliates.co) and affiliate network operated by Migo Media Private Limited ("we", "us", "our").
1.2. These Terms apply exclusively to affiliate publishers, media buyers, and business partners ("Publishers"). This website is not intended for and does not provide services to gambling end-users or players.
1.3. By registering as a Publisher or using this website, you agree to be bound by these Terms.
1.4. We reserve the right to update these Terms at any time. Continued use of the website constitutes acceptance of any revised Terms.
2. Publisher Eligibility and Registration
2.1. To join the Amigo Affiliates network, you must be a legally constituted business entity or individual operating as an affiliate publisher, website owner, media buyer, or content creator aged 18 or over.
2.2. You must provide accurate and complete information during registration. We reserve the right to reject any application at our sole discretion.
2.3. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
2.4. We may require identity verification (KYC) documentation before approving your account or processing commission payments.
3. Commission Structure and Payments
3.1. Commission rates (CPA, Revenue Share, or Hybrid) are agreed between Migo Media Private Limited and the Publisher at the time of onboarding or as otherwise communicated in writing.
3.2. Commissions are calculated based on qualifying actions (player registrations, first-time deposits, or net gaming revenue) generated by traffic you refer to our partner operators, as tracked by our affiliate tracking system.
3.3. Commission payments are subject to: (a) a valid invoice submitted by the Publisher; (b) successful KYC verification; and (c) the absence of any suspected fraud or policy violation.
3.4. We reserve the right to withhold, reverse, or adjust commission payments in cases of fraud, invalid traffic, self-referral, or breach of these Terms.
3.5. Payments are made via Wire Transfer or USDT (TRC20). Publishers are responsible for any applicable taxes on commissions received.
4. Publisher Obligations and Prohibited Conduct
4.1. You must ensure all marketing activities comply with applicable laws and regulations of the jurisdictions you target, including UK Advertising Codes (CAP/BCAP) and local gambling advertising regulations.
4.2. You must not direct marketing at persons under 18 years of age or in jurisdictions where online gambling advertising is prohibited.
4.3. You must not use misleading, deceptive, or aggressive marketing practices, including false bonus claims or guaranteed win representations.
4.4. You must not use incentivised traffic, cookie stuffing, typosquatting, brand bidding (without prior written approval), or any form of fraudulent traffic generation.
4.5. You must not promote gambling services in any GEO not approved under your specific deal terms.
4.6. All marketing materials must include appropriate responsible gambling messaging and the 18+ age restriction notice where required by applicable regulations.
5. Intellectual Property and Licence
5.1. All intellectual property rights in the Amigo Affiliates website, brand assets, and marketing materials are owned by Migo Media Private Limited or its licensors.
5.2. We grant you a limited, non-exclusive, revocable licence to use approved marketing materials solely for the purpose of promoting our partner operators under your active affiliate agreement.
5.3. You may not sub-licence, modify, or use our brand assets outside the scope of this licence without prior written consent.
6. Termination and Suspension
6.1. Either party may terminate the affiliate relationship at any time by providing written notice.
6.2. We reserve the right to immediately suspend or terminate your account without notice in cases of fraudulent activity, breach of these Terms, illegal conduct, or conduct that damages the reputation of Amigo Affiliates or its partner operators.
6.3. Upon termination, any outstanding commissions will be reviewed. Commissions generated through fraudulent or non-compliant activity will be forfeited.
7. Limitation of Liability
7.1. To the maximum extent permitted by law, Migo Media Private Limited shall not be liable for any indirect, incidental, or consequential damages arising from your use of this website or participation in the affiliate network.
7.2. Our total aggregate liability shall not exceed the total commissions paid to you in the three months preceding the claim.
7.3. We make no warranties regarding the accuracy or completeness of any content on this website.
8. Links to Third-Party Websites
8.1. This website contains links to independently licensed gambling operators and other third-party websites for affiliate publisher reference only.
8.2. Amigo Affiliates does not operate, endorse, or take responsibility for the content or services of any third-party websites. All gambling activities take place solely on the operators' own licensed platforms.
9. Responsible Gambling Compliance
9.1. As a publisher in our network, you acknowledge that the gambling sector requires particular care in advertising and promotion.
9.2. You agree to include responsible gambling messaging in all promotional materials where required by regulation, including links to GambleAware (begambleaware.org) and GamStop (gamstop.co.uk).
9.3. You must never target or market gambling services to vulnerable persons or those who have self-excluded.
10. Use of the Website
10.1. You may use this website for lawful purposes only and must not transmit any unlawful, defamatory, or harmful material.
10.2. You must not attempt to access any part of the website that you are not authorised to access.
11. Governing Law and Contact
11.1. These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Gurugram, Haryana, India.
